TERMS AND CONDITIONS

PLEASE READ THESE TERMS THOROUGHLY AS THEY CONTAIN IMPORTANT INFORMATION REGARDING YOUR LEGAL RIGHTS, REMEDIES, AND OBLIGATIONS.

 

This User Agreement (the “Agreement”) is the terms and conditions that shall oversee, apply and govern the relationship between the user i.e. the Client or Freelancer as identified in these Terms and Conditions (“you” or “User”) and Jaser  (“Platform,” “we,” or “us”). You must read, consent to, and accept all of the Terms & Conditions contained in this Agreement to be a User of our platform located at jasertalents.com or any part of it. 

 

This Agreement incorporates following agreements, as they may be in effect and modified from time to time as per the Platform's sole discretion but you as User shall be notified about any such amendments: Code of Conduct, Privacy Policy and the payment instructions shall be applicable and enforceable to any agreement you enter into with another User. These agreements are collectively, with this Agreement, called the “Terms & Conditions”.

 

Jaser may, in its sole discretion, amend these Terms and Conditions  and other Agreements part of the Terms & Conditions at any time by posting a revised version on the platform. In case of any substantial amendments to the platform and its functioning, the Platform shall provide reasonable advance notice of any such amendment by posting the updated Terms & Conditions either on the Jaser platform, and/or sending notice to the Users by email. Any such amendments will take effect on the noted effective date. If the amended Terms and Conditions are not approved by the User, the Platform maintains the right to restrict the User from accessing his or her account under its sole and absolute discretion.

 

YOU UNDERSTAND THAT BY USING THE PLATFORM AND ITS SERVICES AFTER THE EFFECTIVE DATE, YOU AGREE TO BE BOUND BY THE TERMS & CONDITIONS IN ITS ENTIRETY. IF YOU DO NOT ACCEPT THE TERMS IN ITS ENTIRETY, YOU SHALL NOT ACCESS OR USE THE PLATFORM OR ANY OF ITS SERVICES AFTER THE EFFECTIVE DATE EXCEPT AS PERMITTED BY THE PLATFORM TERMS & CONDITIONS.

IF YOU AGREE TO THE TERMS & CONDITIONS ON BEHALF OF AN ENTITY, OR IN CONNECTION WITH PROVIDING OR RECEIVING SERVICES ON BEHALF OF AN ENTITY, YOU CONSENT TO HAVE THE AUTHORITY TO BIND THAT ENTITY TO THE TERMS & CONDITIONS OF AND AGREE THAT YOU ARE BINDING BOTH YOU AND THAT ENTITY TO ANY AND ALL APPLICABLE TERMS & CONDITIONS. THE PLATFORM RETAINS THE ABSOLUTE RIGHT AND AUTHORITY TO REQUEST ANY AUTHORIZATION DOCUMENTS FROM COMPANIES WHETHER LOCATED AND REGISTERED IN OR OUT OF BAHRAIN, INCLUDING BUT NOT LIMITED TO BOARD OF DIRECTOR RESOLUTIONS AND SHAREHOLDER RESOLUTIONS AS IT MAY DEEM FIT AND NECESSARY AT ITS OWN DISCRETION. 

Definitions

‘’Account’’ means the account associated with the User's email address. Each User may register as both Client and Freelancer at the same time.

‘’Client’’ means a User, either natural or legal entity, who is a service seeker and engages Freelancers to supply services through the platform. 

‘’Freelancer’’ means a User or a service provider who offers and provides services through the platform.

‘’Platform’’ means a freelancing portal available at: Jasertalents.com and any of its domains or properties, as well as any related service, tool or application.

‘’Services’’ means all services provided by a Freelancer, either upon a Client's invitation or Freelancer’s promotion of his/her services. In the service category on the platform, freelancers can enlist and offer their services in the form of a project, by setting out details of a project such as brief description, specific category, starting and fixed price per service as pre-determined by Freelancer, delivery time and brief introduction about freelancers’ expertise.

‘’Project’’ refers to a job offered and promoted by the Client setting out details of a project such as brief description, project type, price, completion date, skills required, and industry category. It is aimed at inviting Freelancers to bid for a specific project and hiring them accordingly. 

‘’Category’’ refers to industries of freelancers’ expertise as enlisted and offered on the platform. 

“Proposal” means the document produced by the Client to Freelancer setting out the fee, project description, timetable and any other relevant details for the project in question. Upon acceptance of the proposal, both parties abide by the terms of that specific proposal and they shall be considered as a contractual relationship.

“Price” means the price as stated on the proposal by the Client to the Freelancer for the project in question. 

‘’Rating’’ refers to rates or any other types of measuring the performance of a Freelancer that will be visible on his/her profile and according to which s/he may enjoy some benefits/perks. 

‘’Initial Service Payment’’ means the first payment made by the Client to the Freelancer for the provision of services to be released upon the project completion. 

‘’Milestone Payment’’ means a payment made by the Client to the Freelancer for the provision of services to be released in accordance with the section "Milestone Payments" of the proposal.

‘’Hourly rate’’ means a rate set by the Freelancer for the provision of his/her services. 

‘’Agreement’’ refers to Terms & Conditions, Code of Conduct, and any other terms related to the use of the Platform and any of its parts, currently applicable as of the day these Terms and Conditions, or as may be decided upon by the Platform on any future date.

‘’Terms & Conditions’’ refers to these terms of service of the platform including but not limited to User Agreement and Privacy Policy, equally applicable to all platform users.

“In Writing” means any communication in written form including paper-based communication and electronic communication by email or fax.

‘’Documents’’ means all records, reports, documents, papers and other materials whatsoever originated by the Freelancer pursuant to this Agreement.

‘’Dispute Resolution Center’’ means the procedure to be followed by both Clients and Freelancers in case of any disputes arising among them. 

‘’Event Date” means the date (s) on which the Client has engaged the services of the Freelancer.

‘’Intellectual Property Rights’’ means any and all intellectual property rights, means any and all intellectual property rights, existing worldwide and the subject matter of such rights, including: patents, copyright, registered designs, registered and unregistered trademarks, and any right to have confidential information kept confidential and any application or right to apply for registration of any of the rights enlisted.

‘’Confidential Information’’ means any confidential information of the Client which may be known to or come to the Freelancer's knowledge by reason of its engagement under this Agreement and/or these Terms and Conditions (whether before, during or after the signing of this Agreement), referring to without limitation to the business dealings or affairs or prospective business dealings or affairs of the Client,  the intellectual property in the documentation owned, licensed or used by the Client, the trade secrets and finances of Client, any information obtained by the Freelancer in the course of its engagement that is manifestly confidential or any information designated by the Client as confidential and information in relation to which the Client owes a duty of confidentiality to any third party.

‘’Force Majeure” means any event or circumstances beyond the reasonable control of either the Client or the Freelancer or any person acting on his/her behalf which could not by its nature have been foreseen or even if foreseen it was unavoidable to occur, such as act of God, wars, floods and similar events. 

1. Jaser Accounts

1.1 Registration and Acceptance

1.1.1. By registering for an account to use the Platform (an “Account”), and following the User reading and accepting the Terms & Conditions upon entering the Platform, the User agrees to abide by this Agreement and other Terms & Conditions.

1.1.2. To access and use certain features of the Platform and the Platform Services, Users must register for an Account. Subject to the Terms & Conditions, certain features of the Platform are available to the visitors before their Account registration is approved. Jaser reserves the right to decline a registration to join the Platform or to add an Account of any type (i.e., as an Client or Freelancer), as it may deem fit and necessary in accordance with its sole discretion.

1.1.3. If a User creates an Account as an employee or on behalf of a company, s/he represents and warrants that s/he is authorized to enter into binding contracts, including the Terms & Conditions, on behalf of the company. The Platform maintains the right to request that any corporate entity that registers under the Platform provide the necessary authorization documents issued in favor of the corporate entity's

1.1.4. Jaser offers the Platform and the Platform services for business purposes solely and not for any personal, household or consumer use. In order to register for using the Platform, Users thereby consent that they act as (a) independent individual/ business or an agent on behalf of another company (b) for business purposes only and (c ) to comply with any applicable rules and regulations with regards to their business or the business that they represent. In the event any User breaches the terms of this Clause 1.1.4, Users waive the Platform from any liability arising out of or in connection with the failure by the relevant Party to comply with this Clause 1.1.4.

1.2 Account Profile

1.2.1. To register for an Account to join the Platform, you must complete a User profile (“Profile”), which you consent to be shown to other Users of the Platform, and may be publisized by the Platform for any purpouse it may deem necessary in its own discretion, inlcuding but not limited to research, marketing , adverstising, across any platform including but not limited to printed materials such as newspapers and magazines, websites, social media, etc.

1.2.2. Users agree to provide true, accurate, and complete information on their Profiles and all registration and other necessary forms on the Platform or to update any such information in a truthful and accurate manner. Users commit themselves not to provide any false or misleading information about their identity or location, business, skills, or the services to be provided as well as to correct any such information that is or becomes false or misleading.

1.2.3. User shall hold the Platform free from any liability and shall accordinly indmenify Jaser from costs incurred by the Platfrom arising out of the User producing false, incorrect or misleading infromation provided during the course of creating the Account, or submitted to the Platform by the User in any capacity during, before or after the creation of the Account.

1.3 Account Types

There are two Account types at our platform. Users can register as either Client or Freelancer.

Jaser reserves the right to revoke the privileges of any of these Accounts or access to or use of the Platform without notice if determined that false or misleading information was provided in creating, marketing, or maintaining either Profile or Account.

1.4 Client Account

1.4.1. The User can register for an Account to use the Platform as an Client (“Client Account”).

1.4.2. A User holding an Client Account shall use the Account for the sole purpouse of requesting professinal business services;

1.4.3. A User holding an Client Account hereby acknowledges that the utilizing of the Freelancer's Services through the use of the Platform, shall in no capacity and under no circmustances, be construed as establishing an employment relationship with the Freelancer;

1.4.4. A User holding an Client Account may only request one Service/Job from one specfic Freelancer at a time, and may only request another service from the same Freelancer , when the Milestone Payment is released from the Platform's Escrow Account;

1.4.5. A User holding an Client Account shall not hold the Platform liable in any capacity for a failure by the Freelancer to provide the request within a stipulated time-frame, failure to provide the request in accordance with a specfic standard and/or quality;

1.4.6. A User holding an Client Account hereby recognizes and acknowledges that the Platform does not have any professinal or personal relationship with any Freelancer, nor does the Platform accept liability and/or responsibility for any messages, covenants, or representations made by the Freelancer to the Client.

1.5 Freelancer Account

1.5.1. Freelancers can register for an account to use the Platform as a Freelancer (a “Freelancer Account”).

1.5.2. In future, additional feature may be added of registering as a Team (a ‘’Team Account’’).

1.5.3. If a group of freelancers registers as a team, such an Account allows permissions to be granted to Users under Team Account that can be given different permissions to act on behalf of the Team. In case of being hired as a Team, it is the sole responsibility of the Team to consider the team members as either contractors or employees as well as to ensure they are paid in accordance with applicable laws for the services provided;

1.5.4. A User holding a Freelancer Account assumes full responsibility for delivering any Projects within the required time-frame, and to provide the Project within the reasonable and expected quality of service, and shall be solely and fully liaible for any consequential legal actions that may be taken in regards to their failure in adhering with the requried quality of service and required time-frame;

1.5.5. A User holding a Freelancer Account acknowledges and confirms that they hold all the necessary permits, authorizations, licenses, approvals, and/or authority to carry out the provision of the Projects, and shall the Platform free from any liability however arising from their failure to comply with the provisions of this Clause 1.5.5;

1.5.6. A User holding a Freelancer Account hereby recognizes and confirms that no employment relationship with the Client, and/or the Platform, shall be established as a result of the Freelancer performing a Project and utilizing the services of the Platform, and further recognizes and confirms that any service undertaken by the Freelancer is made on a service request basis only, with no long-term commitment and/or employment relationship being established with the Client and/or the Platform. 

2. Identity Verification

Upon registering, the User's Account will be subject to verification, including, but not limited to verification of an official government or legal document that confirms his/her identity. By signing up to the Platform, the User authorizes Jaser to make any necessary inquiries for the purpose of validating his/her identity, location, and confirmation of ownership of email address or financial accounts, all in accordance with applicable laws. Once requested, the User is obliged to timely provide complete information.

2.1 Usernames and Passwords

Every User shall register for his/her own Account. Upon registering for an Account, Users will be asked to choose both username and password. Every User is entirely responsible for safeguarding the confidentiality of his/her username and password. Hereby, Users agree not to share their username or password with any person, except with the authorized person of their legal entity if they are acting on behalf of an entity. The User acknowledges that the Platform shall not be liable for any breach of the User's account for reasons falling outside the legal requirements imposed by local laws and regulations of the Kingdom of Bahrain on the Platform

The User agrees to notify us immediately in case s/he suspects or becomes aware of any unauthorized use of the Account or any unauthorized access to the password for the Account. The User also agrees not to use the Account or log in with the username and password of another User if unauthorized to do so or if any such use would represent violation of Terms & Conditions

3. Client Relationship with Jaser

3.1 Jaser enables Freelancers and Clients to find each other and make transactions directly with each other. The Platform is under no obligation to introduce Freelancers to Clients or vice versa, nor find projects on behalf of either Freelancers or Clients. It is the sole responsibility of the Users to determine and evaluate either the project, or a potential Client or Freelancer.

 

3.2 The User acknowledges, agrees, and understands that Jaser is not a party to the relationship between Client and Freelancer. Without any limitation, all Freelancers are entirely responsible for ensuring the accuracy and legality of any content that is the subject matter of the freelancing services, negotiating, agreeing to, and executing all contractual terms in accordance with contractual deadlines.

 

3.3 Without any limitation, all Clients are entirely responsible for determining the suitability of Freelancers for the specific service by various means such as interviews, negotiating, agreeing to, and executing any contractual terms i.e. completing the payments to Freelancers for the services provided.

 

3.4 All Users acknowledge, agree, and understand that Jaser does not, in any way, supervise, direct, control, or evaluate Freelancers or their work and is not accordingly liable for any agreed project terms. Jaser does not guarantee the quality or legality of the services, nor any Freelancers’ qualifications or their ability to deliver the services, nor Clients’ ability to pay for the services or willingness and intentions of either party to fulfill their contractual obligations, nor the communication or any posts and/or content by either Clients or Freelancers. Although Jaser will provide certain ratings and/or badges to the best Freelancers and Clients, all Users should be aware that such do not represent any guarantee of the quality of the services to be provided or willingness to fulfill any agreed contractual obligations.

 

3.5 Users acknowledge, agree, and understand that they are responsible for determining which contracts to accept and services to provide respectively, the time, type, place, manner and means of providing any services, as well as any agreed price for the services. Furthermore, Users acknowledge and understand that by their engagement on the platform, they are not employees of Jaser, neither eligible for any of the rights or benefits of employment and that accordingly Jaser will not have any liability or obligations towards them. Jaser shall not, in any way, supervise, direct, or control any services provided, nor impose quality standards, pricing or deadlines as all these elements are to be agreed between the Client and the Freelancer.

3.6 Nothing in this Agreement is intended to prohibit or discourage any User from engaging in any other business activities or providing any services through any other channels they choose.

Contractual Relationship

4.1. Contracts

If an Client and Freelancer decide to enter into a Contract, the Contract is a contractual relationship between the Client and Freelancer only. Client and Freelancer have complete discretion both with reference to enter into a Contract and with reference to determining the terms of Contract. Users acknowledge, agree, and understand that Jaser is not a party to any Contract, that the formation of any such Contract between Users will not create an employment relationship between Jaser and any User or any type of partnership or long-time commitment between Jaser and any User.

 

One of the Platform’s features enables payment for the services either upon project completion or in several milestones. It is at the discretion of Clients and Freelancers to determine the most preferred mode of payment.

 

4.2. Disputes Among Users

For disputes arising between Clients and Freelancers, both agree to abide by the dispute process that is explained further in the Platform’s section How To Submit a Claim Report. If no amicable solution agreeable by both the Freelancer and the Client is reached, parties are free to  pursue other means to resolve their dispute.

 

5.1. Confidential Information

Users may agree to any terms they deem appropriate with respect to confidentiality. To the extent a User provides Confidential Information to the other, the recipient will protect the secrecy of the disclosed Confidential Information with the same degree of care as it uses to protect its own Confidential Information.

 

5.2. Applicable Taxes

Freelancer and Clients acknowledges and agrees they are solely responsible for all and any tax liability associated with payments/membership through Jaser. Accordingly, Jaser shall not withhold any taxes from payments to both Freelancer and Clients.

 

Jaser is not liable for covering any health, employee’ compensation, disability, unemployment or other insurance requested or required by law, and it is the sole responsibility for Freelancer or the Client to cover any such and similar expenses.

Jaser Fees & Escrow

6.1. Fees

Jaser charges 5% commission and 3% service charge on the Client and 5% gig commission covered by the freelancer. Changes to aforementioned rates shall remain with the Platform's sole discretion, subject to the amendment of these Terms and Conditions

A freelancer annual membership fee of BD 20 shall be imposed, which may be increased by the Platform at its own discretion, subject to the amendment to these Terms and Conditions. The Freelancer annual membership fees are exclusive from any VAT rate applicable at any given time by the relevant regulations in the Kingdom of Bahrain

6.2. Escrow Services

The Platform has a linked escrow account for the purpose of Users to deliver, hold, and/or receive payment for a Project and to pay fees to Jaser (“Escrow Services”).

6.3. VAT and Other Taxes

Jaser may be required by applicable law to collect taxes or levies including, without limitation, withholding income tax or VAT in the jurisdiction of the Freelancer (the "Taxes"). Any such fees shall be collected in addition to the fees owed to Jaser under the Terms & Conditions.

6.4. Withdrawal Requests

Withdrawal requests can only be made when the Freelancer has 20 BHD and above in their Jaser Wallet. This does not mean that the Freelancer can withdraw below 20 BHD if they have 20 BHD worth of amount in their Jaser wallet, it has to be full 20 or above. The payment will be released within 3 working days upon receiving the freelancer's withdrawal request.

Compliance & Disclaimer

Users will each create and maintain records to document satisfaction of their respective obligations under this Agreement, including, without limitation, their respective payment obligations and compliance with, these Terms and Conditions, Privacy Policy and Code of Conducts, andany applicable laws, rules and regulations of the Kingdom of Bahrain and/or the jurisdriction in which the User resides. Users are solely responsible for creation, storage and backup of their business records.

7.1. Warranty Disclaimer

THE SITE AND THE SITE SERVICES ARE PROVIDED “AS IS” AND ON AN “AS AVAILABLE” BASIS. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, JASER DISCLAIMS ALL EXPRESS AND IMPLIED CONDITIONS, REPRESENTATIONS, AND WARRANTIES INCLUDING, BUT NOT LIMITED TO, THE WARRANTIES OF MERCHANTABILITY, ACCURACY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. SOME JURISDICTIONS MAY NOT ALLOW FOR ALL OF THE FOREGOING LIMITATIONS ON WARRANTIES, SO TO THAT EXTENT, SOME OR ALL OF THE ABOVE LIMITATIONS MAY NOT APPLY TO PLATFORM USERS

7.2. Limitation of Liability

Jaser is not liable, and Users consent not to hold Jaser liable,and/or  responsible for any damages or losses, whether direct or consequental,arising out of or in connection with the Terms & Conditions including, but not limited to:

 

  • Delays or disruptions in the functioning of the Platform;
  • Viruses or other malicious software obtained by accessing, or linking to our Platform;
  • The content, actions or inactions of third parties’ use of the Platform;
  • A suspension or other action taken with respect to Users’ Account;
  • Users’ reliance on the quality, accuracy, or reliability of job postings, ratings, recommendations or feedback;
  • Users need to modify practices, content, or behavior or loss of or inability to do business, as a result of amendments to the Terms & Conditions.

 

IN NO EVENT WILL JASER OR ITS AFFILIATES OR OUR THIRD-PARTY SERVICE PROVIDERS BE LIABLE FOR ANY SPECIAL, CONSEQUENTIAL, INCIDENTAL, PUNITIVE, EXEMPLARY, OR INDIRECT COSTS OR DAMAGES, INCLUDING, BUT NOT LIMITED TO, LITIGATION COSTS, INSTALLATION AND REMOVAL COSTS, OR LOSS OF DATA, PRODUCTION, PROFIT, OR BUSINESS OPPORTUNITIES.

Agreement Term & Termination

8.1 Termination

Unless both the User and Jaser expressly agree otherwise in writing, either may terminate this Agreement at any time, without explanation, upon written notice to the other, which will result in the termination of other Terms & Conditions as well, except as otherwise provided herein. In the event the User properly terminates this Agreement, their right to use the Platform is automatically revoked and the accounts will be closed accordingly. Consequently, User acknowledges that termination of this Agreement will not automatically terminate any contract entered between Users,  as Jaser will continue to perform any site services in order to enable any such contract/project to be completed, transaction between parties executed as well as any due amounts to be paid as of the date of termination of any agreements. The User shall remain obligated to settle any outstanding fees and/or expenses due to Jaser, that remain pending following the effective termination of the relationship between Jaser and the User,

 

Jaser reserves an absolute right to temporarily or indefinitely revoke or limit Users’ access to the Platform or any of its parts in case following is brought to our attention: (1) if User is in breach of Terms & Conditions; (2) if we suspect or become aware that User provided false and inaccurate information; or (3) that any of Users’ actions may adversely impact us and our community due to the illegal or illicit nature of the activities.

For the purpose of deactivating the account or if the User who has been banned aims to rejoin the Platform under a different account, a prior approval needed by Jaser Administrators.

 

In case of account closure for any of the above-mentioned reasons, all the data, materials, correspondence may be erased and Jaser will have no liability whatsoever.

8.2 Survival

Upon termination of this Agreement, the terms of this Agreement and the other Terms &Conditions that expressly or impliedly contemplate performance after this Agreement terminates or expires will survive and continue in full effect. Without limiting any other provisions of the Terms & Conditions, the termination of this Agreement for any reason will not release Users or Jaser from any obligations incurred prior to termination of this Agreement or that thereafter may accrue in respect of any act or omission prior to such termination.

8.3 Dispute Process & Choice of Law

If a dispute arises between the User and Jaser, it is in the mutual interest to resolve the dispute in a fast and cost-effective manner. Jaser in no capacity isssue any decision, rule or suggestion as to any disputes that may arise between the Users, and the Users shall be responsible using their personal means to settle any disputes amonst themselves. With reference to any claims that may arise, they will be governed by and construed in accordance with the laws of the Kingdom of Bahrain.

General

9.1 Entire Agreement

These Terms & Conditions sets forth the entire agreement and understanding between User and Jaser thereby superseding any prior or contemporaneous agreements, representations, warranties, and other communications between the parties, either in oral or written form as long as they relate to the subject matter in any manner.

9.2 Modifications

No modification or amendment to the Terms & Conditions will be binding upon unless they are in writing and signed by a duly authorized representative of Jaser or posted on the platform by Jaser Administrators.

9.3 Severability

If any provision of these Terms & Conditions is held invalid or unenforceable in whole or in part under applicable law, such provisions will be ineffective as to the jurisdiction in which it is illegal, invalid, or unenforceable and will be deemed modified to the extent necessary to conform to applicable law in order to give the maximum effect to the intent of the parties.

9.4 Force Majeure

The parties to this Agreement will not be held responsible for the failure to perform, or any delay in performance of, any obligation hereunder for a reasonable period due to any events beyond their reasonable  control, such as in the case of government imposed regulations and/or restrictions or events such as accidents, fires, floods, telecommunications or Internet failures, strikes, wars, riots, rebellions, blockades and any other similar events.

Privacy Policy

Our Users’ privacy is of utmost importance to us and any information shared on the Platform will be handled with utmost discretion and in accordance with applicable laws, rules and regulations.  The aim of this Privacy Policy is to inform our Users of any applicable policies and procedures regarding the collection, use and disclosure of information through the Platform, and any other websites, applications or online services that are owned or controlled by Jaser or any information that Jaser collects offline in connection with the Service.

 

Personal Information

In provision of our products, services and customer support, we acknowledge that  personal data of our Users may be collected, and Jaser  hereby acknowledges that it shall remain in compliance with all personal data protection regulations currently in effect in the Kingdom of Bahrain.

By using our Platform, Users are asked to provide certain types of personal information, such as Account Details (username, password, profile picture), Identity Details - full name, proof of identity (e.g. drivers licence, passport), Location Details (e.g. physical address, billing address), Contact Details (e.g. email address, phone number), Financial Details (e.g. credit card details, payment processor details) and any content generated by the Users themselves on the platform (e.g. Bids).

The information we request, collect, and process can be used for purposes such as provision of service or product requested by the User, provision of technical or similar support, resolution of any complaints, testing and building up on the Platform or any other instances whereby User provides explicit his/her consent.

The Users’ hereby approve and give their free and informed consent that  their personal information may be processed and held by  third party providers, such as cloud hosting providers, payment and banking providers or analytics providers, Jaser maintains no accountability or responsibility to the personal data protection measures undertaken by any third-party providers, however it will endeavor to the best of its capabilities, to collaborate and be assisted by accredited third-party providers.

Jaser may disclose Users’ personal information to third parties if required to do so by law or court order of the Kingdom of Bahrain, and Jaser shall be required to notify the User of such disclosure upon being aware of the necessity to make the disclosure (unless Jaser is legally prohibited from making such notice), but is not required to obtain the prior approval and/or consent of the User in order to make the necessary disclosures

Code of Conduct

Jaser is a web and mobile freelancing platform in the Kingdom of Bahrain. We developed Jaser Code of Conduct (hereinafter referred to as: ‘’Code of Conduct’’) as a guideline to the usage of our platform appropriately as well as to ensure its legality, confidence and utmost professionalism by all relevant stakeholders. This Code of Conduct is mandatory to be followed at all times and any violation of this Code may result in a disciplinary action as well as ban from the platform. This Code is applicable for all users and shall be complied with in its entirety.

Application

This Code of Conduct is to be followed by management, employees, consultants of Jaser, and any entity related to or owned by the Jaser, as well as any other person acting on behalf of Jaser.

Purpose

This Code of Conduct outlines policies and procedures for Jaser’s management, employees, consultants and other personnel representing Jaser on means of conducting business in a variety of circumstances.

Policy

All the platform users shall observe the highest standards of corporate practice and business conduct. This Code of Conduct sets out Jaser’s policies on various matters including ethical conduct, business conduct, compliance, privacy, security of information, communication as well as any fraudulent activities.

Business Conduct

We aim to deliver an extraordinary experience for all our users in an honest and fair manner, observing integrity in all our dealings.

We will always approach our business with the clear intention to operate within the boundaries of the law. Our principles and procedures guide us in our business dealings and decision-making and they are designed in order to reflect our legal obligations and limitations.

Integrity & Confidentiality

All platform users trust shall ensure that the trust is maintained between parties in a specific contractual relationship by acting ethically and with integrity. It is of utmost significance for all users to respect the confidentiality and privacy of the platform and all associated parties. It is strictly prohibited to disclose any information or any type of documents, in any format, other than those which may be required by the law or authorized by Jaser.

Contact & Communication

It is forbidden for any users to contact other users asking for their personal contact details. Also, it is forbidden to add any links or content containing contact information to the profile, portfolio, listed job or service. The official website features such as the platform's messaging system is the only communication channel between all parties. All users shall restrict their communication to the platform only, for the purpose of executing projects via platform. All users must avoid any inappropriate remarks, any form of discriminatory practices or non-professional and unethical behavior.

All communication should be among the portal.

Bidding

Jaser encourages all users to participate in all bid (s); however, the user must bid only on the project which he/she can complete and commits to do accordingly. Users must not submit his/her quote intentionally for benefits other than serving the purpose of the platform. All users must report if they reveal that any of the project(s) is involved in the fraudulent or illegal activities.

Fraud & Spam

Jaser users must follow all legal procedures and by consenting to use the platform, they are obliged not to get involved in any kind of fraudulent activities. Each user is allowed to create only one user account and registration of multiple accounts is strictly prohibited. Users shall not use this platform to generate false information or feedback about any user or service. Users are also prohibited to advertise their personal blogs, websites or personal advertising materials unless otherwise allowed.

Copyright infridgement

All work performed through Jaser must be original. Reproduction and distribution of protected work without the creator's permission is strictly prohibited. In addition, people who create derivative work (work that is copied or adapted from another piece of work) without proper authorization are also infringing copyright. Jaser does not make judgments about what legally constitutes a “derivative work”. When we receive allegations of copying, our response is solely determined by whether the design is in violation of our site rules.

Warnings

If the TOS are violated, the user will be given a period of 24 hours to amend the profile or anything that was subject to the violation. In case a user does not perform the necessary action to comply with TOS, his/her account will be suspended.

Code Violations

Any type of possible Code violation will require comprehensive analysis and review by Jaser personnel, as well as taking any actions deemed appropriate. Factors such as the gravity of the violation will be taken in consideration in assessing the penalty for the user who violated the Code of Conduct. These actions shall primarily be in the form of a written warning, and in case users continue violating the Code of Conduct, they will be temporarily or permanently prohibited accessing the platform.
